OpenAI’s ChatGPT Faces Privacy Complaint by NOYB in Austria

Austria’s NOYB has filed a privacy complaint against OpenAI’s ChatGPT, accusing the AI firm of violating data privacy regulations. The complaint was prompted by a user who received inaccurate responses when asking about their date of birth, instead of being informed that the chatbot lacked the necessary data. NOYB claims that OpenAI’s chatbot denied the user’s request to correct or delete the false information, violating EU data privacy laws. Furthermore, the complaint alleges that OpenAI is unaware of the data stored by ChatGPT and its sources, despite being aware of the issue. NOYB argues that chatbots like ChatGPT do not comply with EU law, as they can generate false information about individuals, which can have serious consequences. OpenAI has previously stated that factual accuracy in language models is an area of active research. NOYB’s complaint also highlights OpenAI’s failure to respond to data access requests as required by the GDPR. OpenAI is already under investigation by Italy’s national privacy authority for data breaches and the exposure of user conversations and payment details. The European Data Protection Board has also established a task force to address issues surrounding ChatGPT and ensure compliance with data protection regulations. Additionally, Elon Musk has filed a lawsuit against OpenAI, claiming that their partnership with Microsoft deviates from the principles of advancing open-source AI for the benefit of humanity.
